GRENADA GOVERNMENT TO PROCEED WITH CASE AGAINST DIPCON
ST GEORGE'S, Grenada: The Government of Grenada on Thursday won what it called another significant judgment in its case against Dipcon Limited. The Court of Appeal ruled that the Government can go ahead with its law suit against Dipcon. This judgment comes after Dipcon’s lawyers filed an application in Court seeking to prevent the Government from going ahead with its law suit. Government’s Legal Advisor to Cabinet and Special Prosecutor Mr. Hugh Wildman successfully argued that under the Grenada Constitution Dipcon’s argument against the Government did not meet the test to get leave to go to the Privy Council. Mr. Wildman submitted that Dipcon’s application did not satisfy the test under Section 104.1 or Section 104.2 of the Grenada Constitution to qualify for leave to go to the Privy Council. Mr. Wildman today said that “this judgment means therefore that the Government’s multi million dollar case against Dipcon will proceed to trial. The implications are significant because Government could wipe out the damages which Dipcon obtained years ago when they got a default judgment against the Government of Grenada.” Government is suing Dipcon for breach of contract over its handling of road works and quarrying along the Eastern Main Road Reprinted from Caribbean Net News caribbeannetnews.com
